    It’s likely you’ve heard the term “short sale” thrown around quite a bit. But what, exactly, is a Las Vegas short sale?


    A short sale is when a bank agrees to accept less than the total amount owed on a mortgage to avoid having to foreclose on the property. This is not a new practice; banks have been doing short sales for years. Only recently, due to the current state of the housing market and economy, has this process become a part of the public consciousness.


    To be eligible for a Nevada short sale you first have to qualify!

    To qualify for a short sale:

    § Your house must be worth less than you owe on it.

    § You must be able to prove that you are the victim of a true financial hardship, such as a decrease in wages, job loss, or medical condition that has altered your ability to make the same income as when the loan was originated. Divorce, estate situations, etc… also qualify.

    Now that you have a basic understanding of what a short sale is, there are some huge misconceptions when it comes to a short sale vs. a foreclosure. We take the most common myths surrounding both short sales and foreclosures and give a brief explanation. LET’S BUST SOME MYTHS!!


    1.) If you let your home go to Nevada foreclosure you are done with the situation and you can walk away with a clean slate.  The reality is that this couldn’t be any farther from the truth in most situations. You could end up with an IRS tax liability and still owing the bank money. Let me explain. Please keep in mind that if your property does go into foreclosure you may be liable for the difference of what is owed on the property versus what is sells for at auction, in the form of a deficiency balance! Please note this is state specific and in most states you will be liable for the shortfall, but in some states the bank may not always be able to pursue the debt. Check your state law as it varies widely from state to state.

    Here is an example of how a deficiency balance works 

    If you owe $200,000 on the property and it sells at auction for $150,000, you could be liable for the $50,000 difference if your state law allows it.

    Not only could you be liable for the difference to the bank, but in some situations you could also be liable to the IRS! Although there are exemptions (mostly for principle residences) under the Mortgage Debt Forgiveness Act, there are times when you could be taxed on both a short sale and a foreclosure, even in a principle residence situation. Since the tax code on this is a little complicated and I am not a CPA, I advise always talking to a CPA when in this situation as you are weighing your options. Hard to believe?  Well, believe it or not, the IRS counts the difference between the sale and the charged off debt as a “gain” on your taxes. That’s right-you lost money and it’s counted as a gain! (I didn’t make that rule, that’s a wonderful brainchild of the IRS). Banks and the IRS can go as far as attaching your wages. Not to mention if you let your home go to foreclosure you will have that on your credit, as well.

    Guess What?  A short sale can alleviate your liability to the bank, in most situations. There are also exceptions to this, but in most cases banks are releasing homeowners from the deficiency balance on a short sale.


    2.) There are no options to avoid Nevada foreclosure. Now more than ever, there are options to avoid foreclosure. Besides a short sale, loan modifications along with deed in lieu are also examples of the many options. In most cases (but not all) a short sale is the best option. Either way, there are more options today than there have ever been to avoid foreclosure.


    3.) Banks do not want to participate in a short sale, or, it is too hard to qualify for a short sale. Banks would rather perform a short sale than a foreclosure any day. A foreclosure takes a long time and creates a huge expense for the banks; a short sale saves both time and money. Banks have more foreclosure inventory than ever before, and certainly do not want any more. Banks more than ever welcome short sales. Qualifying for a short sale is easier than you think, you need to have a true financial hardship, or a change in your finances and your house has to be worth less than what you owe on it. Not only do consumers, but banks also now have government incentive to participate in short sales.


    4.) Short sales are not that common. At this present time, short sales range from 10-50 % of sales in various markets and it is predicted that in 2012 we will have more short sales than any other year, to date. Due to economic changes in the last few years, this is something that is affecting millions of Americans. Short sales are in every market, and are not just limited to any particular income class. This has affected everyone from all facets of life. A short sale should be looked at as a helpful tool, not a negative stigma. That is why the government is offering programs that actually pay consumers to participate in short sales. It is not just affecting one community; it is affecting communities and consumers across the nation.


    5.) The short sale process is too difficult and they often get denied. Though the short sale process is time consuming; it is not as difficult as the media would have you believe. The problem is that most short sales are denied because of a misunderstanding of the process.  It is true that if the short sale process is not followed correctly there is a good chance of getting denied. An experienced agent knows how to avoid this. Short sales require a lot of experience, and a special skill set. If you are looking to go the option of a short sale make sure your agent is skilled and experienced in this area.


    6.) Short sales will cost me money out of pocket.  A short sale should not cost you any out of pocket money. In fact, you could get between $3000-up to $30,000 to participate in a short sale. In many ways, a short sale may put you in a better financial position than prior to the short sale. Almost every short sale program now has some type of financial incentive for the home owner, as long as it is a principle residence, and we are even seeing relocation money being paid on some investment/second homes. As a seller of a property you should never have to pay for any short sale cost upfront to any professional service. Realtors charge a commission that is paid for by the bank. In most communities there are also non-profits and HUD counselors who can help you with foreclosure prevention options for free. The only potential cost you could incur is if the bank would not release you from a deficiency balance in the short sale, which is happening less and less now.


    7.) If I am behind on my payments, I can perform a short sale any time. The farther you get behind on your payments, the harder it is to get a short sale approved. The closer a property gets to a foreclosure the harder it is to convince the bank to perform a short sale. As they get closer to a foreclosure sale more money is spent, thus deterring them from doing a short sale. If you think you need to perform a short sale, time is of the essence; the sooner you start the process, the better. Waiting too long can trigger the ramifications of a foreclosure, losing the ability to do a short sale as a viable option.


    8.) I have already been sent a foreclosure notice so I can’t perform a short sale. For the most part just because you received a foreclosure notice or notice of default it does not mean that you do not have time to perform a short sale. The timeline and specifics do vary from state to state, but having done short sales all over the country, I have seen banks postpone a foreclosure to work a short sale option as close as 30 days prior to the scheduled foreclosure auction, but the longer you wait the less chance you have. If you have received a legal foreclosure notice, please reach out to a professional right away. The longer you wait, and the closer you get to foreclosure, the fewer options you have. If you have received a notice to foreclose this means the bank is filing paperwork and starting the process to take legal action to repossess the house. You still have time at this point to prevent foreclosure, but do not hesitate! The closer you get to the foreclosure date the harder it becomes to negotiate with the bank for whichever option you choose.


    9.) I was denied for a loan modification, so I know I will get denied for a short sale.  Short sales and loan modifications are handled by two separate departments at the bank. These processes are totally different in approval and denial. If you got denied for a modification you can still apply for a short sale; in some cases you can get a short sale approved faster than a loan modification, as some loan modifications are denied because they cannot reduce the loan low enough based on the  consumers income.


    10.) If I go through a short sale I cannot buy another house for a long time. The time to buy another house depends on your entire credit picture and can vary from 12-24 months. There are even a few FHA programs that allow for a purchase sooner than that. I have worked with clients who went through a short sale and bought another house in less than 12 months.

    These are just a few of the common myths surrounding short sales and foreclosure. With the options available today, no homeowner should ever have to go through foreclosure, and hopefully this information can help a few more homeowners think twice before walking away from their home not realizing the possible long term ramifications a foreclosure can have.

Although lenders will consider a short sale similar to a foreclosure, The chances of getting a home loan will still be slim for a bit.
    • Tax Consequences -- Talk to your accountant to see if you qualify for the Mortgage Forgiveness Debt Relief Act of 2007, no taxes are owed on the forgiven debt.
    • Bank Could Demand a note or some payment -- The bank is not forced to forgive the debt. They may ask you to pay them back for the difference on the sale and what is owed on the mortgage, but you'll need to agree to this.
    • The mortgage holder/lender does not have to say yes to a short sale
    • You must prove a hardship that prevents you from making your payments.
    • A short sale is not short. The time depends on how quickly you and your agent put together the hardship package, and how quickly the lender reacts
    • Lenders are known for taking a while to approve short sales.
    • If your home has liens, each lien holder/lender must be consulted.
    • The successful transaction depends on a good offer from a good buyer.
    • The real estate agents involved will usually get a smaller commission.
    • You may be asked to sign a promissory note for the debt forgiveness for approval .
    • Lenders may seek repayment of the debt forgiven after the short sale is completed.
    • Your credit score is going to take a hard hit. Consult tax and legal advice.
    • You could be taxed. Consult a tax professional.

    This is one of those blog posts where the ideas and desires to get them out have been burning in my soul for days. The hours waiting have created an insatiable hunger to share and an overwhelming desire to have the reader, for just a moment, feel what I felt when putting this message together. I need your heart to beat just a little harder and your blood to pump just a little faster as you FEEL the message in this post.

     

    Sit down, Buckle Up, and Take this ride with me for just a few minutes.

     

    August 2011 - This is the day that I was blessed to have Seth Campbell step into my life.  I created a group on Facebook with the intent to mastermind with the greatest team builders in the Real Estate Business. I wanted a forum where I could ask questions to other Mega Agents who have been or currently were where I'm going. I was desperately seeking a place without judgement but with the KW culture that encourages us to all share openly and learn from one another. I also knew that in this group, I would share my growth with others who have not yet been where I am but intend to go there. I would Pay it Forward while I was learning from the greats. 

     

    Something Magic happened in this group when Seth Campbell Arrived. I was immediately drawn to his language and his unapologetic passionate delivery about leadership, behavior, and business. He struck a cord with me. I began following him intently and discovered that he was a regional director AND a 7th level mega with his team being in another state.     So you can imagine, when I heard Seth was Teaching RSTLM (Recruit, Select, Train, Lead and Motivate - a Keller Williams Training Course on becoming successful through people) - I wanted to be there. The disappointment was overwhelming when I found out that this class would be across the US in Panama City, Florida. It was to follow a very expensive educational even that would take place just a week prior and our education budget was already inflated. In addition, we had no babysitter for our 9 year old daughter. I spent a couple weeks trying to plan the trip with girlfriends so my husband could stay home with our daughter, but nothing panned out. On March 31st, I sent a Facebook Message to Seth that said I would be unable to make it due to life circumstances. I finished by saying "Maybe the universe will still pull me in that direction" to which he promptly replied - "There are those that the universe pulls and those that pull the universe." 


    That one line lit a fire in me. So I did not pull the universe- I YANKED IT! I immediately found my husband and said "If I can work out the funds, and work out a babysitter that Tabitha likes, Would you be OK with us Going?"  "Absolutely", he replied (with an eye roll and a shoulder shrug as if to say - Oh Yeah! THAT is going to happen.


    So there I was, on May 1st, just a month later - on a Plane with my husband to Panama City. Amazing. I made a very purposeful decision that I would not be my normal self. I would not "work the room" in an intent to create a spotlight, and I would not allow any self serving emotions to interfere with my ability to learn. I wanted to be a sponge and hear every word Seth had for us. ** I did JUST THAT**



    Clearly, I can't teach you the course in a blog post, nor am I an instructor for RSTLM. But I want to highlight some of the points that hit home with me.  

     

    Seth opens by explaining that Gary Keller suggests we take RSTLM 6 times each year for 3 years and then begin teaching it. He tells us that there is a time though to go from being a professional student to a professional implementer. "RSTLM is not a supplement to our business", Seth Says "It IS our business and we are talent scouts". Seth begins by explaining that RSTLM has a lot to do with finding the right "MATCH" and then Keeping the Band Together. He explains that Marginal people bring marginal profits and that Good is the enemy of great.  I love that as he recognizes the successful Mega Agents in the room, and shows extreme respect to the talent there such as Barbara Van Poole, Jackie Ellis, and Aaron Armstrong (to name only a few), he also acknowledges that every one of our teams are screwed up in one way or another - and that's OK. He continues by saying that RSTLM is a tool to help us avoid some of the nightmare hires and headaches that go along with building a successful business. He explains that RSTLM is 100% "P" (as in the E to P theory). He continues by saying that RSTLM is so foreign and unnatural that our very blood will want to fight it. But he explained that it's the GAP we must all fill. 

     

    Upon partnering us with Accountability Partners, he also says "It is a MYTH that anyone can hold themselves accountable" and encourages us to all have someone we can be held accountable to such as a coach.  

     

    I had serious issues though when Seth, armed with a black magic marker in his left hand, begins keeping Score on peoples thoughts, comments, and Aha's.  Wait - This is a competition? I nearly had a heart attack as I had committed to not let anything bring out my "game". So guess what - I lost. I ACCIDENTALLY got one point (but secretly - I won *BIG*)

     

    Favorite A-Ha's and Quotes from the class......

     

    • It's never about YOU, it's always about THEM

    • When you have decided to have success through OTHERS, you have to find the RIGHT OTHERS.

    • Talent will not stay with Non Talent on a team

    • "Luck is not part of my business plan" ~ Seth Campbell

    • The gap of what you WANT and what you HAVE is always TALENT

    • Hire talent for where you will be in 3 years, not for where you are now

    • Talent will not work for you if they don't see you as a vehicle for THEIR success.

    • You can always trace wealth to leverage

    • Without RSTLM you have about a 30% chance of hiring the right person. With RSTLM, you can raise that to about 90% - but each shortcut will reduce points. 

    • Talking to one new person a week will change your life 

    • Seth does 10 to 12 AVA's prior to a hire

    • "Always be building a bench" - Seth explained the need to always be in relationship with talent and just as in building an all star team, you always want to have a bench of talent. 

    • We discussed Salary vs. Commission and Seth explained many reasons why he prefers salary but expressed that we, as the the leaders, will hold ourselves more accountable to our teams performance when we are writing a check.

    • Decide the Flavor of your team. What will it feel like? What will it look like? What's important to you on your team - Some of the traits that came up were: Passionate, Self Motivated, Learning Based, Loyal, Skilled, Great Attitude (to name a few). Seth encourages us to make a list and then focus on the top 3 that are the MOST important to us in people and make sure we bring on talent that fits those key traits.

    • Protect the culture of your team above all else

    • In explaining some behavior on the DISC (which he emphatically states that there is no good behavior or bad behavior, just different behavior) - He says a HIGH D says " I'm going to get more" where a high I says "Let's go get more" - not bad - different!

    • He goes into detail on the AVA and explains that Vector 5 is the gap between conscious restraint and response

    • He explains that behavior sometimes changes with age and that people usually decide who they are going to be somewhere between 31 & 35.  

    • One of my FAVORITE details of the AVA Seth gave us was the difference between the highs and lows on the Vectors. He explained that we, as the leaders, need to be very focused on the vector that our talent leads with and feed it! We need to make sure the energy is there, on the vector they lead with, to give them joy. That was a BIG A-HA for me and something I intend to focus on when I get back into the team. 

    • He encouraged us to pay special attention to the VERBS our candidates use. When reading the AVA, pay special attention to the first 3 lines and focus on the verbs. The first 3 sentences are the most "true" (before the subconscious kicks in and starts buffering the language). - ((This was a big a-ha for me as I have been listening for adjectives, and I can now actually see the difference.))

    • Hire someone that will be successful next year with or WITHOUT you. 

    • A Zebra never changes its stripes

    • The Life story and Comprehensive Interview are about Track Record and Trajectory. You don't want to hire someone when they are on a downhill slope.

    • "The key to being an amazing leader is understanding how people think" ~ Seth Campbell

    • Look for Bouncebackability

    • Trying to force people to do things unnatural to them is like pushing a rope. Put people in the right positions for them

    • When interviewing candidates you have be OK with stopping and walking away

    • If you want EXTREME Talent, your vision has to be HUGE ( - uh yeah - THAT one gave me chills)

    • Seth explains that we have to have accountability. After all, would a talented team of all stars play a baseball game without a scoreboard?? (nice one Campbell!)

    • Reward the behavior, NOT the result

    • Pay attention to how people LEARN. www.vark-learn.com has an assessment

    • Leaders are not problem solvers - They TEACH others to solve their own problems.

    • If someone is not performing on your team, use a performance wheel to rate them. Which one is the lowest? (Accountability, Authority, Responsibility, Habits, Skills, Attitudes, Knowledge). After you have done this - look at your leadership. Many times their weakest item is a mirror of the leader. 

    • Seth pulled a fast one on us when he asked us how we motivate others. After writing down all of our answers, he said write the word "MYTH" across them because people can't be motivated by someone else. Motivational is internal and only a person can motivate themselves! Our job is to find out what that is for THEM and help THEM get it. 

    • A 411 is NOT A TO DO LIST. It should be focused on the TOP 20% only that reach the monthly and annual goals. 

    • The KASH talk encourages the language of TALENT vs. Non Talent

    • Everyone should know Everyone's goals on the team

    • "In the absence of knowing what's important. You will think Everything is important or Nothing is Important" ~ Seth Campbell

    • Something I observed and LOVED is when Seth would put his hands in his pocket, position his body in a receptive and curious manner, show interest and then say "Tell me more about that".- I don't know if it's intentional or natural, but I observed the behavior and how open the speaker became after he did that. 

    • THEIR personal goals must match YOUR personal goals to be a WIN

    • If you really want to get in touch with someone and their motivators "Get The Book" - (I had never heard of this but was fascinated watching how it works. - I will spend some time on this one)
     
    In closing, all I can say to any of you that are interested in building teams and becoming successful through others, Take RSTLM / RS again and again - Learn it - and Implement it. This was our 3rd time taking portions. We had done RS (1) , and RSTLM Mega twice before this, and still walked away feeling like we have so much more to learn.

I personally am seeking out the leaders that I best respond to because I feel I can learn better from people that "speak my language" if you will.
